Supporting Positive Behaviour

1. 1 Describe the Policies and Procedures of the setting relevant to promoting Children and Young People’s positive behaviour. Every setting should have a behaviour policy, in England, it is a legal requirement for early years setting. This is a document to promote a positive behaviour of children and adults involved in the setting, it will help all staff to know what we should do in different situations.As a part of this policy there will also be procedures for staff to follow, such as, showing respect to children and other adults or, giving a explanation to the child who is finding it difficult to observe boundaries or, being a positive role model with appropriate behaviour. Also, the policy should detail the strategies that will never be used in the setting. The codes of conduct relate to the behaviour of staff as well as the behaviour of children. These must be managed in a manner appropriate for children age, stage of development and individual needs.For the staff, the co de of conduct will include, for example, keeping calm to stop children hurting each other or behaving in a unsafe way, such as, listening to both sides of the story in a conflict or, not make any negative comments in front of the children. For children, the codes of conduct are about playing safely, respecting others or taking turns. These codes are discussed with children making a Golden Rules, for example, please walk no running or we should share toys with our friends; this helps them to take responsibility for their behaviour and they feel part of the process.To support children’s positive behaviour we will use Rewards, it is based on the idea that, if they receive approval, they are likely to want to repeat that behaviour There are many types of rewards that work well with children. Praise is a very effective way of reinforcing positive behaviour, saying to children ‘well done’ or ‘good boy/girl’ helps them to know that they have shown positive behaviour and stating clearly what it is that is good, e. g. ‘Thank you for sharing the toy, that was very kind’. Attention is one of the best ways of reinforcing positive behaviour.Making eye contact, smiling or nod, it helps the child to know that we have seen what they have done. In my setting, at the end of each session, teachers ask children who has followed the golden rules that day and they get a smiley face. The children are invited to sit in the fairytale chair or on the fairytale step. Sanctions will help us to respond to inappropriate behaviour. For example, saying ‘no’ in a quiet but firm way or, explaining the consequences of actions to their level of understanding helps children to understand why they must no carry on with their behaviour.Rewards and Sanctions should be used appropriately and fairly. For dealing with conflict and inappropriate behaviour we may use different strategies to show that we can manage that situation. For example, ign oring the behaviour, if children are not getting any response from the adult, they will then change what they are doing, when they stop that behaviour we must give them plenty of positive attention. To removal equipment, this sends a message to children that what they are doing is not acceptable or safe. Also we can use facial expression to make children realise that what they are doing is not acceptable.Guidance on inclusion will be a tool to collate all policy relating to all children with additional needs as Special Education Needs or, Gifted and Talented, also the nursery has a policy of having available to all, a variety of items which reflect the cultural diversity of our country. The nursery displays many pictures and posters of children and people from all areas of the world to reflect the inclusion policy. There are many puzzles and other materials available which reflect our diverse society. We want children recognise that certain actions are right and that other are wrong .Children must be encouraged to recognise that bullying, fighting or hurting are not acceptable behaviour and they will not be tolerated. Anti-bullying policy is to ensure that children learn in a safe, supportive and caring environment, without fear of being bullied. Bullying is a complex issue and takes many forms (racial, sexual, disability,†¦ ). It can be physical, verbal or emotional and can be cause serious psychological damage. A child often bullies for a reason, it is important to try to find out why a child may be bullying others, usually a child that is bullying has some personal difficulty that needs addressing.Biting policy will follow in the event of a child being bitten. Biting is a form of behaviour that is particularly prevalent in children whose language skills are only just developing and can often be an expression of frustration because they cannot yet express their feeling and it can become a habit. In this cause we must act immediately, to explain to the bi ting child why biting is unacceptable, that it hurts the other child and show the mark. Remove the biting child from the circumstances and keep him busy at all times. We will always inform the parents about the incident and should keep confidentiality.Attendance policy is usually part of a school’s code conduct because children’s education can be affected if they do not attend regularly or are often later for lessons, being absent from the school means a lost learning opportunity. To ensure that each child is encouraged to attend from the first day that they enrol at reception. However, in an early years setting, this is not likely to be part of a behaviour policy. In any case, there must be a time control input and output. 1. 2 In your own words describe what your setting behaviour policy expects from adults and children.In my setting we believe that children grow up best when their personal, social and emotional needs are met and where there are clear expectations fo r their behaviour. The aim is to teach children to behave in socially acceptable ways and to understand the needs and rights of others. To help children to learn to empathise with others, understanding that they have feelings too. Where children behave in inconsiderate way, we help them to understand the outcomes of their action and support them in learning how to cope more appropriately.All staff, volunteers and students must provide a positive role model of behaviour by treating children, parents and one another with friendliness, care and courtesy. Also we must use positive strategies to resolve any inconsiderate behaviour, by helping children to find solutions in ways are appropriate for their age and stage of development. We must be calm and patient helping to manage children’s feelings. 1. 3 Describes with examples the importance of all staff consistently and fairly applying boundaries and rules for children and young people’s behaviour.It is very important that all staff consistently and fairly apply boundaries and rules for children’s and young people’s behaviour. For example, if we want to teach children that they must eat sitting and not playing, all staff must apply the same rules every single day in the lunch time, not allowing toys and remind them to sit down when they stand up, because if children with a staff member can run and play while they eat but with another member they must eat sitting. They are confused about this change in the rules from one day to another and they cannot know which behaviour is the correct.

Reflective Report During the last term, i have had learned some knowledge from the subject called introduction to finical accounting. For me, this is the first time I had chance to learn this subject, before that I just heard some information about IFA by reading the FT newspaper and watching the news. When I start learning that, this subject gives me the impression that it is difficult to understand. During the past few months, I can say I already mastered some of the skills in IFA.I can still remember the first lecture I had learned was the definition of the â€Å"Accounting Equation†, I can conclude that the most important thing you must master is you should try to distinguish the meaning of the capital, assets and liability. Assets are economic resources of the business that are expected to bring benefits for the business in the future, the Important point is it can bring you benefits in the future instead of consuming at the end of the year. Capital, we can also called ow ners’ equity is the economic resources that was contributed by the owners of the business to the business.The last component is liability which is the name given to the amounts owing to these people or organizations for these assets. The format of the accounting equation is capital + liabilities = assets. When I learn this subject, I think the interesting part is the double entry which is the basic part of the whole subject. What I have learned is each transaction requires one debit entry and one credit entry and for each pair of entries: the left hand side must therefore equal right hand , only you know how to put the items into debit part or credit part can you prepare the account correctly.In my opinion, mastering this skill essentially is very necessary for my future careers. I think the future financial professional is not limited in numeracy skills. The reason is this area is requiring the accountant have ability to be able to explain and analyze the transactions, maste ring numeracy skills is essential for every accountants but I think the most important factor is having an analytical ability in order to deal with different types of transactions efficiently.Back to the subject, besides the double entry, the next basic point is the transactions analysis, which is very significant to future professional, always be awareness of professional judgment and personal effectiveness. When we going to analyze one transaction, the first thing we should concentrate on is transaction whether cause stock to increase or decrease. Stock increasing consists of the purchase of additional goods and the return into the business goods previously sold. However, stock decreasing involves the sale of goods and goods bought by the business now being returned out to a supplier.When you handle one transaction the first step is going to prepare Journals, determine nature and double entry of each of the transactions. Let me indicate my feeling when I use MYOB. When I handle one transaction I should create one computer and write related information in detail, then start to prepare a journal according to the transaction. Write the date accordingly, when I use this software, I don’t know where to start. I find the significance of understanding double entry; you should know each transaction whether is assets account capital account liability account.If put it in a wrong entry, what we have done is all in vain. I ought to also prepare account for bank, purchase, sales and depreciation, this procedure is a little complex. When I prepare T-account at the same time I must recorded. Return back the main menu select the report, it shows the trial-balance, different statement of income and statement of financial position, all of that will appear automatically i n place of preparing manually. Have ability to good use of MYOB project is very necessary, which will avoid existing of errors so as to save time and help you become professional.Through MYOB project and prepare account manually, I am aware of the importance of numeracy skills to a future financial professional. Numeracy skill means have ability of counting correctly, distinguishing between sets of unequal quantities, operations such as subtraction and addition. The reason why IT is so important for financial professional is that all financial transactions contain the exchange of information, the increasing popularity of online finance accorded with advances in IT fields.After finishing the bookkeeping test, I can summarize some of my learning experience and I have my own notions in learning some of difficulty parts. The learning style I preferred is when you are taught a new topic, you should fully understand it immediately in case of delaying it into another day. In addition, you’d better do a revision at the end of the weekend; this will help you master this topic better. However, I also suffered some difficulties during the last few months, when I learn a topic called depreciation; I always confused with depreciation for non-current assets and disposal.Therefore, . In my view, the most annoying thing is combine the expense account with the accrual and prepayment account, it always made me crazy. But I never give up; always keep the faith to solve these problems. I think the best way to avoid this confusion is totally up to you. Once you have made a mistake, you must discover the weakness of this part and try your best to solve this problem so that you will never make the same mistake over and over again.This metho d would not only be helpful for your learning in the future, but also would bring a surprise and achievability to you. Another main point is being awareness of cooperation. Through discussing with your friends, you can also easy to find the solution. My tutor helps me a lot during the last few months as well. The northern coastal side is forested which consist to about 4.5% of the total land area (Sahar, 2007). It has two prominent mountain ranges. These are Alborz Mountain Range with the highest peak of. 5671 meters above sea level and it geographically located near Tehran ( Sahar, 2007). The other Zagros Mountain Range which stretched across the southern part of the country with a peak of of about 4000 meters above sea level. The dessert part of the country is located at the eastern parts which are named Dasht-e-Kavir and Kavir-e-Lut (Sahar, 2007). Iran’s capital city is Tehran with an estimated population of 14 million pesos. The city is also visited with about 4 million people from neighboring communities. Recently, the areas of Arak, Ahvaz, Esfehan, Kerman, Shiraz, Tabriz, and Mashad of Iran have become an emerging industrial zone (Sahar, 2007). Iran climate vary. Ascension Catholic Church Visit The Ascension Catholic Church is located in 2950 North Harbor City Blvd Melbourne Florida. The close proximity of the church from my home enabled me make a visit to the church last Sunday for the morning mass at 9.30 am. My neighbor who is a member of the church had earlier invited me to visit the church with him on Wednesday evening. He further informed me of the churchs dressing code and even suggested that I accompany him to the church. However, since I wanted to get more exposure I declined this offer. Instead, we resolved to attend the Sunday service since it had higher attendance from the congregation (Ascension Catholic Community1). The Ascension Catholic Church is a member of the Diocese of Orlando that consists of other churches within Florida. The church is located in a serene environment that makes it an ideal location for worship. The actual church building has a sitting capacity of approximately one thousand two hundred people. On the right at the entrance, I dipped my finger and made a sign of the cross on my forehead in a holy water font. My neighbor friend informed me that the father had blessed the water and this is used as reminder of baptism. It further signifies respect as one enters into the house of God amongst Catholic faithful. The same routine is repeated as faithful exit the church (Ascension Catholic Community1). History of the church and nature of worshippers I was welcomed into the church by members of the welcome team who usher in new parishioners and orient them into the church. This greatly uplifted my spirits and I felt appreciated and recognized by the church. The congregation at Ascension Catholic Church varies widely representing all ethnicities and age groups of the community. The church has therefore created several masses to cater for all groups of the congregation. The church has further created special categories of the congregation ranging from pre- schoolchildren to junior high schools and teenagers. The adult population consists of special interest outreach groups that cater for disadvantaged members of the society such as the deaf (Ascension Catholic Community1). The deaf ministry for instance, holds special meetings with those with hearing impairments to encourage and nurture them spiritually. In addition, the job seeker ministry consoles those who have lost employment while also helping them in searching for other alternative sources of income. The Vietnamese community on the other hand, helps immigrants to settle comfortably in America. There is also a community of Hispanic Americans and a different one for Philippines at the church (Ascension Catholic Community1). The Boy Scout movement however, seeks to develop the physical fitness and moral characters of young men in the congregation. Retirees also have their unique group through which they share ideas and life experiences. Female members of the congregation sponsor days of recollection and other social programs and events that benefit the community. The bereavement ministry helps families cope with death of loved ones while also supporting funeral arrangements. The church also collaborates with the community of hope to provide shelter to the impoverished families to build homes. The church also runs a scholarship fund for bright children and uses volunteers to steer most of its daily activities. This further exemplifies the kind and caring nature of most worshippers at the church. For instance, the transportation ministry transports the sick and elderly to church services and hospital visits (Ascension Catholic Community1). Description of the church and significance of the symbols used At the front of the church at the pulpit, there was the bible. However, my friend corrected me that the pulpit was actually known as a lectern and the lectionary as the Catholics refer to it contains parts of the Bible that the father uses to conduct mass. There were different statues in different positions within the church. These statues represented different saints. Moreover, the saints, believed to be in heaven overlook upon the faithful and guide them in their daily lives. For one to become a saint, they have to live exemplary lives while on earth and present good examples to others. There was also a statue of Mary holding her baby, Jesus Christ (Ascension Catholic Community1). In front of the statue, there were lit candles that are a symbol of prayer. I also noticed 14 pictures all round the walls of the church. These Stations of the Cross tell the story of the suffering and eventual death of Jesus at the hand of Romans. These stations guide Catholic faithful in prayer during the lent period that precedes the Easter festival. At the front of the church, hanging from above there was a cross with a figure on it. This crucifix I was informed represented Jesus crucification on the cross. Some faithful bowed to the crucifix as they entered the church as a sign of respect and adoration for Jesus (Ascension Catholic Community1). At the middle front of the church, an altar covered in cloth with candles around it is the main figure. On the left of the altar, there is a baptismal font where baptismal rites take place on occasional basis. In addition, there was a cabinet containing three vessels of oil. One is for blessing and strengthening those preparing for Baptism, another for the sick and the third is used in giving sacraments to the faithful. The tabernacle is used to keep holy Eucharist used in communion. The lamp hanging above this small place further represents Jesus presence in inside the special house. Therefore, the catholic take the tabernacle to be the holiest place in the church. The Pascal candle is a symbol of Jesus resurrection and is therefore replaced every Easter. Finally, the canopy hanging above the altar represents the time Jewish were wandering in the desert. Moreover, the canopy serves to remind Catholics of their journey with the Lord (Ascension Catholic Community1). The actual service and its significance We all stood up as an introductory song was sung as the priest and ministers entered and proceeded to the altar. The purpose of this opening song was to deepen our unity as the Mass began. After a greeting from the Father in form of a short prayer, we went back to our seats. A group confession of sins followed by singing a hymn before the Father closed the first session with an opening prayer that concludes the introductory rites to every mass(Ascension Catholic Community1). In the liturgy, we celebrated Gods word by listening to his message from the Bible. This celebration is essential to deepen our faith and thank God for the gift of life. A first reading came from the Old Testament to embrace the role of Jesus as a link between the past and present. This was concluded with a reflective psalm that also created an atmosphere of prayer. The second reading came from the book of Mathews to motivate us in facing the challenges of the modern world. The reading reflected our current challenge of electing a new president in the coming weeks and encouraged us to have faith in Gods guidance to make the correct choice (Ascension Catholic Community1). A gospel reading from the book of John formed the gospel reading for the Sunday and marked the climax of the liturgy of the word. The sermon taught us that by proclaiming the gospel, we welcome Christ amongst us. Listening to the Gospel proclaimed further reminded us and identified us with the first faithful who heard these teachings from Jesus himself. At the end of the reading, the father proclaimed the gospel of the lord to which we affirmed. After reciting the Apostles Creed, individuals presented their own prayers to the Lord from the altar (Ascension Catholic Community1). Worshippers then proceeded to give their offerings through a collection basket that went around. All types of gifts were also presented to the altar from a procession that included children. The father blessed these gifts and asked Jesus to accept them on our behalf. The father later conducted a different thanksgiving prayer requesting the Lord through his Holy Spirit to transform the gifts into his body and blood. This epiclesis recalled the last supper when Jesus shared the last meal with his disciples before his eventual betrayal. In a moment of silence, the church remembered the sacrifice of Jesus (Ascension Catholic Community1). The short meditation is crucial to keep his memory by believing in his death, resurrection, and eventual ascension. This memorial further challenges Christians to be ready to make sacrifices as Jesus did while remembering all those who have passed on. Afterwards, church attendants proceed to partake of the holy sacrament that represents Christs body while the wine represents his blood that he spilt to save humanity. Public announcements followed before the priest concluded the service (Ascension Catholic Community1). My experience The service was generally enjoyable except for some of the prayers that I was not accustomed to reciting. The visit was a revelation and I learnt many aspects of the Catholic Church. This has consequently changed my perception on Catholics and the presence of statues in their church. I fully understand the symbolism of these and fully appreciate their beliefs. Furthermore, the priest was lively and used real life experiences in relating the sermon to our daily life experiences. I also found the choir extremely wonderful by the hymns they sung and the dancing by little children from the Sunday school. Moreover, the congregation was friendly and very hospitable to visitors (Ascension Catholic Community1). What needs to be improved The church should expand the sitting capacity to accommodate more faithful. I noticed some worshippers stranded outside because of the limited seats available. The parking lot should also be expanded to accommodate more worshippers cars. However, these seem not to hinder the congregation visiting the church since all masses are always full (Ascension Catholic Community1). Conclusion I really enjoyed my visit to Ascension Catholic Church. Apart from the spiritual nourishment, I gained valuable insight into Catholic history and beliefs. My interaction with the friendly congregation further encouraged me to make regular visits to the church. Finally, I might just make more visits to the church in future to build on this new learning and spiritual experience. This will enable me to break the routine monotony from my church occasionally. Are CIF Contract of Sale of Goods a Sale of Documents? RESEARCH PROPOSAL A Cost, Insurance, and Freight (CIF) contract of sale is a sale of documents instead of sale of goods. HYPOTHESIS: A Cost, Insurance, Freight (CIF) contract of sale is completed when documents are sold instead of the goods. INTRODUCTION AND ACADEMIC RATIONALE: This research proposal will explore the field of Cost Insurance Freight (CIF) contract of sale and it will provide enough references and evidences towards answering the question of: That whether CIF contract of sale of goods is a sale of documents or not? Documents here refers to the contract documents which are the proof of the sale. These documents include the Bills of Lading, Commercial Invoice, and the Insurance Policy. The proposal will also put light upon the context that a CIF sale contract is completed once the documents are tendered correctly even before the goods are delivered. The research objectives for this proposal are presented here, by a series of sub questions: The nature of a CIF contract-Is it a sale of documents or sale of goods? What are the main documents which completes the CIF contract of sale? Why is more emphasis given on symbolic delivery of goods using the documents? What is the concept of passing of property and risk in a CIF contract of sale? What are the duties of the buyer and the seller in a CIF contract of sale? What is High Seas Sale (HSS) and its concept in a CIF contract of sale? The CIF term started with the expansion of the trade and commerce. The first reported case of CIF was in 1862 and 1871 and at that time it was mentioned C.F.I. instead of C.I.F. in a CIF contract the buyer or his agent need not be present physically and the payment was deferred to a mutually agreed date by the buyer and seller.[1] Hamilton J defined the obligations of a CIF vendor; which re as follows: First, to ship at the port of shipment the goods contained in the contract; Second, to procure a freight contract, under which the goods will be delivered at the agreed destination; Third, to arrange for an insurance which will be available for the benefit of the buyer; Fourth, to make out a commercial invoice; Fifth, finally tender these documents to the buyer.[2] It follows that against tender of these documents the buyer must be ready and willing to pay the agreed contract price. Furthermore, in a CIF contract of sale the emphasis is on the symbolic delivery of goods, using the documents which has and carry the title to those goods which are mentioned in the contract of sale and are being shipped. It is a cash against documents contract.[3] LITERATURE REVIEW: To conduct research on the topic CIF contract of sale is a sale of documents instead of sale of goods, it is very much important to firstly obtain some background knowledge on the CIF contract of sale as well as the reasons and evidences which will support and strengthen our topic and will show and proof that CIF contract of sale is a sale of documents. This literature review is contains parts which explains the CIF contract of sale and the relevance of documents in the CIF contract. These include: The nature of a CIF contract, the main documents which completes the CIF contract of sale, the concept of passing of property and risk in a CIF contract of sale, the duties of the buyer and the seller in a CIF contract of sale, High Seas Sale (HSS) and its concept in a CIF contract of sale. This literature review is in accordance with the objectives of this research, which it will explain the need of documents in a CIF contract and as to why a CIF contract of sale is a sale of documents. The Nature of a CIF Contract To start with, a COST, INSURANCE, FREIGHT (CIF) contract of sale is that contract in which the buyer buys the goods from the seller by paying the entire amount till the final port where the goods are to be discharged and delivered to the buyer. The sale price term includes the cost of the goods, insurance, and freight. For Example: 9,000 100lbs. bags of Wheat CIF Le Harve shipment June 2016 cash against documents. Today a CIF contract is one of the most important instruments which is used in international trade and international sale of goods. In a CIF contract the obligations of the seller is to ship the goods to the port which is being agreed upon by the buyer and the seller, and this port is also known as the final port of delivery or the port of discharge. Next is to get a contract of freight from the carrier on which the goods will be shipped to the agreed port and destination and then to arrange for an insurance which will cover the goods against the loss during the transit and this will benefit the buyer and then to make a commercial invoice. After all this the final obligation of the seller is to tender the documents to the buyer in the correct way and the correct manner which have been agreed by both buyer and the seller. After the documents are tendered and they are accepted by the buyer, the buyer is then bound to pay the agreed contract price of the goods and the contract is fulfilled and performed. About to the nature of the performance of the CIF contract, especially where the importance is given on the tendering of the documents in the correct manner rather than physical delivery of goods, some jurists and academic writers are of the view that CIF contract of sale is a sale of documents rather than goods.[4] The main documents which completes the CIF contract of sale and the concept of passing of property and risk In the CIF contract of sale, the importance is on the symbolic delivery of goods which is done using the documents which has the title of the shipped goods.it is a cash against documents contract. The main documents in a CIF contract of sale are Bills of Lading, Insurance policy, Commercial Invoice. The commercial invoice shows the contract price and the buyer must pay once these documents are tendered. The advantages of a CIF contract are that the buyer does not have to worry about the freight prices and insurance premiums and the changes if any happen to the prices, as the buyer pays the entire price till the final delivery port. The buyer also knows the exact price which he has to pay. The property in a CIF contract of sale may pass either on shipment or on tender of the documents and the risk generally passes on shipment, but the possession does not pass until the documents which represents the goods are handed over in exchange for the price. The presumption is property passes in CIF contract of sale when documents are delivered to the buyer.[5] The judgement of Scrutton J also said that a CIF contract is a contract of sale of documentsin the cases of Karberg (Arnhold) Co v Blythe Green, Jourdain Co. The judgement became very famous. The judgement lies as: I am strongly of opinion that the key to many of the difficulties arising in CIF contracts is to keep in mind the cardinal distinction that a CIF sale is not a sale of goods, but a sale of documents relating to goods. It is not a contract that goods shall arrive, but a contract to ship goods complying with the contract of sale and to tender those documents against payments of the contract price. He buys the documents, not the goods, and it may be that under the terms of the contracts of insurance and affreightment he buys no indemnity for the damage that has happened to the goods. In my view, therefore, the relevant question will generally be not what at the time of the declaration of tender of the documents is the condition of the goods? but what, at the time of the tender of documents, was the condition of the documents as to compliance with the contract of sale? This ruling has been observed in later cases.[6] Whatever happens to the goods in transit, the Bills of Lading and the Insurance Policy provide an almost complete continuous cover from the port of shipment to the port of destination. If the goods are lost at sea the documents remain valid and can be tendered as normal for the full purchase price to be paid.[7] Justice McCardie held in Manbre Saccharine Co Ltd v Corn Products Co Ltd, whereby he said that the obligation of the vendor is to deliver documents rather than goods to transfer symbols rather than the physical property represented thereby. This supports that documents seem to be the essence of the CIF contract.[8] If the seller hands over the documents to the buyer before payment, then it is presumed that the seller reserves the title until payment.[9] The duties of buyer and the seller in a CIF Contract of Sale The duty of the seller is to ship the goods afloat which are mentioned in the contract and makes a contract of carriage of goods by sea to port of arrival at his own expense. Obtaining a bill of lading and the insurance policy, tender these documents i.e. commercial invoice, Bills of lading and insurance policy to the buyer. The buyer should accept the tender of conforming documents and pay the contract price which is against the delivery of documents. The documents must be strictly conformed to the contract, and the documents can be re-tendered if they are not conforming to the contract of sale.[10] High Seas Sale(HSS) and its concept in a CIF Contract of Sale In a CIF contract when a buyer (actual consignee) has the documents like the Bills of Lading, Insurance Policy, and the Commercial Invoice, he can then further sell those goods to someone else, and he can do so when the goods are still sailing and in the sea. The second buyer can also do this to someone else and the documents are sold for the price. This type of sale is known as HIGH SEAS SALE (HSS) in which the goods are sold while they are still sailing and they have not reached the final port. A high seas sale is done when the goods have left the loading port and are in the sea but have not arrived at the port of discharge. If something happens to the goods, then the buyer has the insurance policy and he can claim the damages from the insurance company. The importance of documents can be supported from the statement made by Lord Porter in Comptoir dAchat et de Vente du Boerenbond Belge S/A v Luis de Ridder Limitada (The Julia) [1949] A.C. 293 at pp.309, 312: The obligations imposed upon a seller under a c.i.f. contract are well known, and in the ordinary case include the tender of a bill of lading covering the goods contracted to be sold and no others, coupled with an insurance policy in the normal form and accompanied by an invoice which shows the price and, as in this case, usually contains a deduction of the freight which the buyer pays before delivery at the port of discharge. Against tender of these documents the purchaser must pay the price.[11] METHODOLOGY: To understand how this research study will aim to be conducted, it is firstly very important to establish the focus and direction it will follow. This will enable us and take us to a certain level where there will be more understanding and more support on CIF contract of sale as a contract for sale of documents rather than sale of goods. From the literature reviewed in preparation for this proposal, it became clear that what most Judges and from their judgements that the obligations of a CIF contract of sale are fulfilled when the correct and conforming documents as per the sale contract is tendered by the seller to the buyer. Because of this, the question that arose in the beginning that why a CIF contract of sale is considered a sale of documents and not sale of goods? is somewhere answered, and after reviewing the literature review in this study, additionally to establishes an answer for the question. To continue, for this study and to meet the objectives, the methodology that will be adopted is that of the doctrinal research method. Doctrinal research is concerned with the formation of what are labelled as legal doctrines, whereby an analysis of legal rules takes place.[12] These legal rules can be located within sources of law such as Statutes and Cases, although it is very important to understand that they cannot fully provide a thorough statement of the law. In regards to this study, it is important to appreciate that this can only be obtained by applying the pertinent set of legal rules to the specific facts and the judgements of the judges who are in favour of the view that a CIF contract of sale is a sale of documents. This research method is colloquially referred to as black-letter law and historically can be seen to be the most suitable method to adopt for research of this nature. Moreover, doctrinal research is concerned with the formation and evolvement of legal doctrines for publication. As this study is essentially asking what is the law? it does significantly differ from the qualitative analysis process used in traditional social science research. So, to conduct this research and to make it clear that a CIF contract of sale is a sale of documents, the judgements in regards to the CIF contract will be analysed. This will enable us to understand why the traders and most importantly the judges are of the view that a CIF contract of sale is a sale of documents. Moreover, the CIF contract of sale is governed by many laws and acts like the Sale of Goods Act 1979, Carriage of Goods by Sea Act 1971, Carriage of Goods by Sea Act 1992, and the main aim is to make it very much clear that the CIF contract of sale is a sale of documents. It is usually inclusive of the sections and provisions from the above stated acts. An extensive list of cases in which the judgements are in the view of the research question which is that a CIF contract is a sale of documents is also included in this research to make the concept and the research clearer. Description: Oxygen uptake kinetics can be explained as all those processes involved in the taking of oxygen from the lung and delivering it to the mitochondrion where it is consumed by the working muscle. Phase 2: This more gradual phase or rapid component is due to the changing kinetics of cellular metabolism and a further increase in pulmonary blood flow (Whipp et al 1980). This phase represents the slower exponential rise to steady state with a time course of 1.5 – 2 min (Linnarson 74) and a fall in the VCO2/VO2 ratio is an indicator for the beginning of phase 2 (Sietsema et al 86). 3. Phase 3: This phase represents the steady state or slow component where oxygen delivery equals oxygen utilization (Sietsema 92), also, Wasserman et al 1967, indicates that a true steady state is not achieved until the concentration of lactate becomes constant. The steady state is reached an about 3 min after the onset of exercise (Diamond et al 1977). D. Oxygen uptake at various intensities of exercise 1. Onset of exercise At the onset of exercise there is an almost parallel increase in cardiac output which leads to increased pulmonary blood flow and rate of pulmonary gas exchange (Whipp and Mahler 1980). Due to stored oxygen and carbon dioxide in the muscle and the venous blood, the rate of pulmonary gas exchange doesn’t equal that in the tissues before reaching the steady state. (Whipp and Mahler 1980). Whipp and Mahler 1980 also indicate that the coupled system is not perfect in that their exists a time delay between gas exchange in the muscle and it expression at the lung and that the VO2 at the mouth may not reflect what happening in the muscle in the first few seconds of exercise. Moderate Exercise Moderate is defined as being sub maximal or oxygen uptake less the anaerobic threshold (a VO2 above which there is sustained increase in blood lactate or carbon dioxide output secondary to bicarbonate buffing of lactic acid). In this intensity of exercise, VO2 rises to steady state by a monoexponential (first order) time course and VO2 steady state increases proportionally to the work rate (Whipp and Mahler 1980). At this intensity ADP accumulates and there is increased glycogen breakdown (Astrand et al 1977) 3. Heavy Exercise This intensity is described as VO2 between the anaerobic threshold, AT, and VO2 max, figure 5. With work intensities above the AT, blood lactate begins to play a role in oxygen uptake kinetics making it more complicated, needing a slow and fast component to describe the response ( Whipp and Mahler 1980 and Whipp et al 1982), the dynamics of which could be described as second order (Linnarson 1974). Whipp and Mahler also indicate that the greater the increase in lactate, the larger is the proportionate contribution of the slower component, and that the time constant is prolonged at this intensity (Linnarson 1974). With heavy exercise and the production of lactate, VO2 continues to rise beyond 3 minutes, the VO2 drift as Casaburi et al 1987 calls it. Severe exercise allows high blood lactate from the anaerobic system to be reached until the exercise becomes unbearable (Whipp and Mahler 1980). Whipp 1972, shows that the time to steady state greatly increases with increasing work rates above the AT. Training Effect on Oxygen Uptake It is a known fact that training improves body performance in some way. Endurance athletes also tend to have greater VO2 due to improved cardiac output and greater arterio-venous differences. Hickson et al 1978 reports a faster rate of VO2 to attaining steady state in the trained than in the untrained state. This indicates that trained individuals reach steady state faster than non trained individuals. Hickson et al also indicates that VO2 time course is determined not only by relative work but also by the level of training. Zhang et al 1991, also found that VO2 kinetics are slower in less fit subjects and Whipp and Wasserman also confirm that VO2 kinetics are faster in more fit individuals. Zhang et al. suggest that a faster kinetics may indicate that in fit subjects the aerobic ATP flux is greater that the anaerobic ATP flux. Casaburi et al 1987 and Yoshida 91, have shown that blood lactate levels can be decreased with endurance training and also suggest that lactate can be correlated to the delayed rise in VO2 (the Vo2 drift). The increase in muscle mitochondria with endurance training may be a factor in improving oxygen uptake kinetics. Biochemical adaptations that occur in the muscle, such as increased mitochondrion size, number and increased capacity for oxidation may increase oxygen uptake kinetics (Girandola 73) which plays a role in uptake kinetics. Berry 1985 indicates that there is an increased capillary density and fiber area with training which may improve oxygen kinetics. One point that Berry 1985 makes is that interval training and steady state training both decrease the time constant, but interval training was found to have a greater effect on the time constant. A. Oxygen uptake in trained athletes differing in VO2 max Those individuals with a higher VO2 max are also found to reach a steady state faster when work is held constant, that is, the lower the VO2 max then the longer time needed for VO2 to reach steady state. Powers et al 1985 indicate that in highly trained individuals with similar training habits, those with a higher VO2 max may achieve a more rapid VO2 adjustment at the onset of work; also, it seems possible that a larger aerobic capacity could contribute to either a more rapid oxygen transport or a higher rate of utilization B. Endurance training increased peak pulmonary O2 uptake by 24 % and maximal ADP-stimulated mitochondrial oxygen consumption by 40 % (Michail et al 2000) C. Daussin et al 2008 showed that a constant workload and O2 uptake during CT induces a higher increase of muscular capillary density than IT. Only high and fluctuating workload and O2uptake during IT improve skeletal muscle mitochondrial function, which seems to be crucial in increasing VÃÅ'†¡O2kinetics, and VÃÅ'†¡O2max, even if both training programs resulted in the same global energy expenditure and training duration IV. Conclusions In conclusion, oxygen uptake kinetics describes the processes that occur at the lung, in the blood and in the muscle to ultimately oxidize fuels into water and carbon dioxide. These systems are intimately linked together and it is the job of sports medicine scientists to identify the various factors and limitations that govern VO2 kinetics. This paper reviews background information on oxygen uptake kinetics with focus on training effect on uptake. VO2 kinetics can be described for moderate intensity, constant load work, as a monoexponential curve to some steady state, the dynamic non steady state being referred to as Phase 1 and 2 while phase 3 being the steady state. The duration of each phase, and hence oxygen kinetics, is influenced by intensity of exercise (light, moderate or heavy) and the duration of exercise. The mechanisms that govern may be peripheral, those processes that involve uptake and utilization in the muscle, or central, those processes in the respiratory and circulatory compartment and everywhere else in the body. The creatine phosphate shuttle hypothesis is the closest to resemble the VO2 kinetics and may be a major player in the VO2 game. VO2 kinetics is seen to be slowed in cardiac and pulmonary disease patients and these individuals are overall limited in the exercise they can do. When prescribing exercise, VO2 kinetics analysis maybe helpful as an indicator of the â€Å"fitness â€Å"of the system and hence which sports are more suitable. From the discussion in the previous sections, it is seen that training may affect mechanisms of VO2. It is known that cardiac output (i.e. stroke vol. X HR), and capillarity are increased with endurance training. These are the central limitations. Also training may affect peripheral limitations, by increasing the size and number of mitochondrion and hence metabolic and oxygen capacities. The increased extraction of oxygen and the increased cardiac output both increase VO2. Since increased exercise increases mitochondrion respiration this may decrease production of lactate which may decrease VO2 drift. Correlating mechanisms with different populations, it can be seen that pulmonary and cardiac patients have lower V02 max and therefore lower VO2. Heart disease also decreases cardiac output and this leads to decreased capacity to deal with metabolic needs. These patients are also limited by oxygen transport and blood flow changes.
